When To or Not To Shoot
Ok, this is a what if post. Let's say you're a truck driver resting in the sleeper birth (the area behind the seats. It has a 38" wide x 80" long bed mattress & some closet/storage area for clothing, etc). There is a privacy curtain between you & the driver & passenger seat blocking your view into the seating area of the truck. Someone forces his/her way into the truck. You're armed with a handgun. You've no idea who this intruder is nor what his/her intentions are. What do you do?

The key points in making the decision to use deadly force are always the same.
1. Do the circumstances of the situation create the reasonable belief that you are in immediate danger of serious injury or death? 2. Is there another reasonable way to handle the problem that won't expose you to the danger of serious injury or death? If the answer to the first question is an unequivocal "Yes" and the answer to the second is a clear "No", then shoot. Otherwise don't.

Let's suppose it ends up being a couple of kids looking for loose change or some odds and ends like radios, etc. Do you kill someone for stealing loose change? JohnKSa gave you the right answer. Unless you want to end up in prison, you'd better make sure the threat is real. As much as I hate a thief, they don't deserve the death penalty for petty theft. Hold them at gun point and call the police.

To shoot or not to shoot...
That's much more of a Tactics and Training question than a question of Law or Civil Rights. Closed for being completely off topic. |
