I was watching a training tape today and noticed that SFPD now has reequipped its Specialist (SWAT) team members with MP5s in 40 S&W. This makes sense as SFPD issues and requires its officers to carry the Beretta 96.

My personal like about the larger caliber SMGs is the design of the magazines. Those straight stick magazines fall freely and allow for faster reloading. There's also a bolt hold open on the larger caliber MP5s.

Does anybody know of any other department which has gone over to the 40 for their SMGs?

There seems to be quite a few here in SC, but this has as much to do with the fact that the agencies in question issue handguns in .40 S&W. Reportedly, one local agency even has the MP5/10 (10x25mm).

I do worry about those who have adopted the MP5/40 and MP5/10; HK announced in October that they were dropping both from production. However, the slack was going to be taken up by their new UMP40 and its big brother, the UMP45.
