(PA) ACLU sues Philly for open carrier-Fiorino

Quote:
The American Civil Liberties Union of Pennsylvania and the law firm of McCausland Keen & Buckman filed a federal lawsuit on February 14, 2012, against the city of Philadelphia on behalf of Mark Fiorino, a gun rights advocate who legally carries an unconcealed weapon in public. The suit alleges that the Philadelphia Police Department filed retaliatory charges against Fiorino after it learned that there was a YouTube recording of Philadelphia police officers threatening to shoot and screaming profanities at an unresisting Fiorino in February 2011. Fiorino was cleared of all charges in October 2011

Now the civil suit begins. Now we will need to wait a couple of years for the outcome.

Go Mark!

I know this isn't a 2nd Amendment suit per se but this is the first I've ever heard of the ACLU getting involved in anything remotely related to the 2nd Amendment.

I have to say I am amazed

Although many state's ACLU chapters do not recognize the individual right, they vary from state to state. Here in Nevada, the ACLU is very pro-2A.

The ACLU is mixed at the national and local levels. That's why we have Google to search for such things. They have worked in concert with the NRA at times on civil liberties issues but in the past haven't seen the 2nd as an individual right. But on arrests and things like that - good job.

Don't be, its really because of the retaliatory actions after the Youtube thing.

If you just type NRA and ACLU into a search engine - you will find instances of joint action on civil rights issues that can revolve around searches, etc. that involve firearms or general civil rights issues.

I was recently elected to the board of directors of the southern Arizona chapter of the ACLU.

The PA ACLU press release: http://www.aclupa.org/pressroom/gunr...esuescityo.htm

The 38 page complaint: http://www.aclupa.org/downloads/fiorino21412.pdf (3160KB PDF)

Getting qualified immunity thrown out in the first 2 incidents may be all but impossible. The last incident, may have the better chance, but it's still an uphill battle.

Our rights are intertwined. We must protect all of them with equal fervor.

It is good that an Eastern Chapter of the ACLU has come to realize this basic fact.

Thanks Al, for posting those links.

The links in the OP only worked for me if I wanted to join that board.
