New York State Gun Control - Passed!

Trying to limit to 7 rounds.
http://www.nbcnewyork.com/news/local...186794151.html

No more garands and then the gun manufactures would have to make a whole new line of magazines for firearms to comply...

Is it even possible for this to happen?

Might be an opening negotiating position with 10 rounds being a "compromise" that "everyone" can agree on.

Nope, seven bullets. I think we can all live with that. No honest man really needs more than 5 bull-its.

Quote:
The tentative agreement would further restrict New York's ban on assault weapons, limit the size of magazines to seven bullets, down from the current 10, and enact more stringent background checks for sales. Other elements, pushed by Republicans, would refine a mental health law to make it easier to confine people determined to be a threat to themselves or others.

Senate Republicans also have included a further crackdown on illegal gun trafficking into New York, the people said. Most New York City gun crimes involve weapons illegally brought into the state, state and city officials say.

The people spoke on condition of anonymity because the proposal had not been discussed among rank and file legislators. They say the tentative deal will be debated behind closed doors Monday in the Senate and the Democrat-led Assembly and could be sent to the floor for a vote Monday.
Quote:
He said a registry of assault weapons will be created, grandfathering in assault weapons already in private hands. He said crimes using guns will get additional mandatory minimum sentences.

"The solution is to get those assault weapons off the street," Silver told reporters.
Solution to What???

Quote:
Former Republican Sen. Michael Balboni said that for legislators from the more conservative upstate region of New York, gun control "has the intensity of the gay marriage issue." In 2011, three of four Republicans who crossed the aisle to vote for same-sex marriage ended up losing their jobs because of their votes.
Now that is curious.

New York city is 5 (I think)

But changing the limit from 10 to 7 is just going to annoy people who do buy guns because there options will be limited because they are not made.

I think they're 10. I think Cuomo wanted to go to 5.

Which, as history has shown, will not be enforced. The remainder punishes the law-abiding while doing nothing to solve the problem.

Crimes don't use guns anyway. I swear my eleven year old son can write a better article than that one.

Or maybe it's time for people in New York to open their eyes and see that disarming lawful citizens is no restrain to crime. A dozen or so 2nd Amendment based suits ought to be filed yesterday.

Right now we have 10 round maximum but we can use preban magazines. I believe this is Cuomo’s way of banning guns outright since many guns don’t have magazines smaller than 10 rounds in existence.

Maybe, he wants everyone to own 1911 government models with the old standard 7 round magazines.
.45 ACP would be the New York standard.

Pretty soon they will want a one round restriction and you have to carry it in your pocket until the need arises...lol. (A little Barney Fife humor)...

As someone who lives in central new york, my blood is literally boiling right now. I have no idea what I will do if this bill passes and it is as bad as people are saying.

It will almost immediately be challenged in court. The Heller decision protects the ownership of handguns, and of weapons "in common use."

Now, does a 10-round cap violate that? Perhaps not. But nobody makes 7-round mags for the Glock 17, the Beretta 92, the Sig P226, the Ruger P95, or any other major service pistol. Cuomo's proposal would effectively ban hundreds of service pistols in common use, and the Supreme Court would be none too pleased to see him flouting their verdict.

Another western New Yorker here starting to seriously consider moving. This is out of hand. Worst part is Coumo is poised for a presidential run next election and we are getting a taste of his hatred towards firearms.

This should help us understand how gun control works.

Hopefully this will help enlighten those who do not own assault style rifles. Who may own a hi-point pistol or a 22 autoloader with a 10 round magazine. Gun control is coming your way!

^^ Move.

Take your intellectual value and your economic value elsewhere. And make sure you tell the leadership of your former state why. Maybe they will get the point. Probably not. In any event... it's your choice where to reside.

They will. Market forces will prevail. And 1911's will come back into style.

Willie

The courts can move VERY fast when circumstances warrant it. The incipient seizure of many peoples' property on questionable legal grounds would certainly warrant it.

Yep, and so would a state legislature blatantly thumbing its nose at the Court's judgment.

And we're not the only ones who know that. At some point, somebody's going to point that out to supporters of the bill, and it's going to be dropped.

Unconstitutional.

This would be an ex post facto law if enacted. An attorney (James Tresmond) in Western New York is already preparing a challenge to the law.

Maybe this would be a good time for magazine manufacturers and gun makers to simply refuse to sell guns, ammo or magazines to the State of NY or any of the political subdivisions thereof. Or at least no more than a 7 round mag.

Why does anyone think a seven round mag capacity will necessarily be declared unconstitutional? The ten round limit has not.

I just talked to Jim. He said that anyone affected by this law should call him at his office tomorrow. The telephone number is 716.202.4301

He's doing the case pro bono.

One way to look at it is that 10-round magazines are readily available. In the eyes of many, limiting handguns to 10 rounds doesn't place a huge imposition on gun owners. In places like New York, most folks already have them by default.

Now, switching to 7 rounds will require new manufacturing and tooling. Such a law will require people to dispose of or relinquish property they already own without compensation. Serious 5th Amendment issues abound.
