ID elected official may lose CCW license over background....

The Idaho Statesman reported that a state elected official may lose his CC license over a undisclosed offense from 1974.

The rep was charged with rape but pled to a lesser crime. He served time & was ordered to leave Florida.

He's now 61 & when he went to renew his Idaho issued CC license the old Florida conviction showed up.

It does sound like a political witch hunt.

And I have to wonder if the question on the application is even legal. If a withheld judgment isn't a conviction, and it's supposed to not leave any record -- why even ask about them? Denials of things like carry permits should be based on convictions, in concert with related laws pertaining to possession of firearms.

By law, applications (and renewal applications) for a CWP are to be on a form mandated by the Idaho State Police: Concealed Weapons License Application.

The question on the form pertains to Idaho Code 18-3302(1)(i) which is one of several means in which you are a disqualified person. It is simply a mechanism to weed out those who may be a danger to themselves or others.

To remedy the situation, you will need to petition the court to dispose of the case, by either expungement, a pardon or by entering a not guilty verdict.

What's the real issue for us?

Are we supposed to be offended that the man convicted of attempted rape got his license pulled, or that the CCL law isn't clear on what sorts of convictions pertain?

I have to admit, I'm wondering what the point of this thread is, myself.

Earlier, I posted an answer as to what the CWP form required. I've been wondering all moening why this thread was started. Since I still can't see any civil rights issues or any issues of law...
