Marlin 1894 45 help!!

Bought my 1894 marlin 45 lc used but in great shape, problem is that it jams every empty case. I put a new ejector spring hoping for a quick fix, but no luck. On further inspection while shooting I noticed it looks like the new round comes up at an angle pinching the empty brass keeping it from being ejected. I tried operating the lever at different speeds if I do it slowly it seems to do better but still not like it should. So long story short whats my problem??

I have my theories but I'm young and inexperienced, parts swapping is easy,but knowing exactly what part is the help I need. Thanks everyone I love this site. Oh I did do a search but didn't come up w/ anything useful, I don't like posting unnecessarily.
