I am not a lawyer but I am betting that well before you get to file your motion to dismiss you are likely to be charged with a felony and have to post a big chunk of money to get out.
The charge might eventually get reduced to a misdemeanor based on the gun having been DROSed previously, but that may well be years down the road.
In the meantime, they will suck the life out of you with extensive legal expenses.
