There is no such thing as a lawful prescription for marijuana. Under the Controlled Substances Act, it is a Schedule I drug and may not, under federal law, be lawfully prescribed.

So anyone using marijuana, even under a state medical marijuana program, is an unlawful user of a controlled substance for the purposes of 18 USC 922(g).
