It analyses yesterday's 9th Circuit CoA victory in
Peruta v. San Diego, in which Judge O’Scannlain's ruling and
127-pg majority opinion contradicted and flat-out
shamed three previous CoA rulings (
Drake in CoA 2,
Wollard in CoA 3, &
Kachalsky in CoA 4), and really thew down the gauntlet for the SCOTUS to take-up
Drake v. Jerejian.
Good news methinks.
