Then we have TENNESSEE v. GARNER, 471 U.S. 1 (1985) 471 U.S. 1 in which the SCotUS ruled that the law allowing an officer to shoot a fleeing suspect was found to be unconstitutional.

So even the police are not allowed to shoot a fleeing suspect if that suspect is not believed to pose a danger or is not thought to be armed.
