I'm not sure how accurate this chart is but - http://www.mail-archive.com/[email protected]/msg91710.html

That used to be a good chart, now I'm not sure how much info is still accurate. In FL everything is legal across the board.

AL, AR, AK, AZ, CO, CT, FL, GA, ID, IN, KS, KY, LA, ME, MD, MO (with C&R), MS, MT, NE, NV, NH, NM, NC, ND, OH, OK, OR, PA, SC, SD, TN, TX, UT, VA, WA (bans use), WV, WI and WY allow unlicensed persons to own silencers.

Check out http://www.silencertalk.com and http://www.subguns.com for forums, legal summaries and other stuff. I make silencers as a hobby and have found that the ATF routinely approves any tax stamp application that is filled out correctly.

I've got nothing but good things to say about the ATF*. They have all been professional, courteous and knowledgeable. The only reason something gets kicked back is that if a state law does not allow it - like the Form 1 manufacture of a suppressor in New Jersey or if there is a paperwork error.

* - (partly because they might have my phones tapped)

My personal dealings with the ATF have always been good ones. I have also never heard of anyone being denied a approval on a tax stamp application as long as the forms were filled out correctly. They are kind of picky at times on how the forms are filled out, but they never disapprove an application just because they can, as far as I know.
