Doj denied me

Hi I purchased a handgun last week at the gun shop
Told me the doj denied me so I called the doj
And was transferred to Yvonne who works
In the mental health in the doj. I left her a message and
Now I'm just waiting to hear back from her
The. First lady I talked to told me it was flagged as a psyc hold
From a behavioral health place.I volunterly check myself into. About 3 1/2 years ago
I was having the worst time of my life my best friend died
My marriage of 18 years was not going to well I was
Just needed to talk and get some help so I called my insurance
And they told me to go to this place so my wife
And I. Drive over there and fill out the paper work
After that I stayed there for almost 48 hours then I was
Allowed to leave on my own. The only people who knew
I went was my wife and 2 kids. But everything worked out
Great I'm very happily married for 22 years now and things
Could not be better. I just want to be clear that there were
No courts or judges involved I did this on my own free will.
I'm in California . Any ideas?? What should I tell Yvonne from the
Department of justice? What do I need to do to get my
Rights back? Is this for 5 years or forever? I really appreciate
All of your advice. I can and have spent hours and hours on this site
Your all a great group here and I thank you .

Sounds like your Social was linked in some way, it could take some resolving, glad your marriage worked out, a good Lady can be a wonderful thing.

I'd guess that your insurance company, or the mental health facility, reported your "visit" to some agency or directly to the NICS system. But they should not have, and (unless CA law differs from Federal law) you should not have been flagged. The Federal law, as reflected in the question on the Form 4473, is if you have been INVOLUNTARILY committed by court order for treatment. You entered voluntarily, not by court order, you were not committed, and you were there for observation, not treatment. Three strikes.

I would go over that with Yvonne if/when she calls back. And also ask her how to get your records cleared if what she's looking at indicates anything different.

My own take on this is that there's more to the story. And in any case, the Internet is a lousy place for the OP to come for advice on a real life legal matter.

[1] No one can really help without all the information. There may be details that are important but are missing. At this point we have only the sketchiest of information.

[2] The Internet is a public place. What's discussed here is NOT confidential. It's a bad idea to discuss personal, serious matters with strangers in public.

[3] The OP needs to find out what appeal mechanism is available and pursue that.

[4] The best thing would be for the OP to find a qualified gun rights lawyer. Among other things, what the OP and his lawyer discusses is confidential.
