Constitutional Carry Hearing Scheduled in Ohio House Committee

State Rep Ron Maag, Committee Chairman, has scheduled a hearing for HB 152, the Ohio Constitutional Carry legislation, for Wednesday, May 27th, at 2:00 PM, in room 121, at the Ohio State House in Columbus. HB 152 would allow unlicensed concealed carry for Ohio residents. Rep Maag has requested that all interested Ohio residents attend the hearing and provide testimony in support of the bill. Rep Maag has been the sponsor of much of the pro Second Amendment legislation that has recently been adopted in Ohio.

Interesting.

Only for Ohio residents? How are they going to rationalize that in relation to equal protection? Their neighbor, Pennsylvania, allows unlicensed open carry (not concealed) everywhere other than within Philadelphia city limits. That applies to anyone in Pennsylvania -- residents and visitors alike.

Ohio also allows unlicensed open carry.

You're right. I completely forgot that.

Nonetheless, I still don't see how the state can allow unlicensed concealed carry for residents but not allow it for visitors. It's that pesky Constitution again -- specifically, the 14th Amendment.

Vermont doesn't require any permit for anyone to carry, open or concealed.

I don't know about Alaska. I know Alaska went to unlicensed concealed carry a few years ago. I assumed that this applied to anyone and everyone within the state, residents and visitors alike. However, I have never done anything to verify that assumption.

Aquila Blanca,

I haven't seen the text of the proposed bill yet. I would assume that the bill would apply to anyone travelling through or visiting in Ohio too. This hearing is the first one scheduled so far. These are the types of questions that should be raised at the hearing.

Relevant text of proposed law:

section to the contrary, subject to the limitations specified in
this division and to division (C)(2) of this section, a person
who is twenty-one years of age or older and is not legally
prohibited from possessing or receiving a firearm under 18
U.S.C. 922(g)(1) to (9) shall not be required to obtain a
concealed handgun license under section 2923.125 or 2923.1213 of
the Revised Code in order to carry in this state a concealed
firearm that is not a restricted firearm
.

Except as provided in divisions (B) and (C) of section
2923.126 of the Revised Code and regardless of whether the
person has been issued a concealed handgun license under section
2923.125 or 2923.1213 of the Revised Code or by another state, a
person who is twenty-one years of age or older and is not
legally prohibited from possessing or receiving a firearm under
18 U.S.C. 922(g)(1) to (9) may carry a concealed firearm that is
not a restricted firearm anywhere in this state.
The person's
right to carry a concealed firearm that is not a restricted
firearm that is granted under this division is the same right as
is granted to a person who is issued a concealed handgun license
under section 2923.125 of the Revised Code, and the person
described in this division is subject to the same restrictions
as apply to a person who is issued a license under section
2923.125 of the Revised Code.
It is not limited to Ohio residents.

Why not just strike the law that said you can't carry. It's nice that it is so clear. But isn't kind of strange to need laws saying what we CAN do?
