Hey i had a question,

"legally" your supposed to hunt with 5 round mag in a rifle right....ok...but what if im using a carbine that shoots pistol caliber ammunition? Also sidearms aren't held to that restriction right??

I'm going pig huntin and I intend to use my Beretta Cx4 (chambered in .45acp) . Which has a 8 round magazine.

Sounds like a good excuse to get another gun, esp. since that .45 is going to be very marginal on wild hogs. If the regs say, no more than 5 rounds in rifles, then that'd be a violation. Get yourself a new full-power rifle!

that or i could use my shotgun but ....thats no fun..

Not all states have a regulation for a 5 round capacity. Check the regs for your state. By the way, if your "carbine" doesn't meet the description of a pistol or shotgun, it is classified a rifle.

If I were in doubt, I would consult my state game department. IMO they will probably be able to steer you in a direction that will keep you out of court.

In my state ofSD when hunting "game" species (i.e. deer) you can not use more than a 5 round clip in an auto (doesn't matter if rifle, carbine, etc..). I have hunted with my old enfield whic has a 10 round mag with no problems because it is not an auto.

For you situation you may have to put in a "filler piece" to restrict the mag capacity to 5 rounds, kina like you have to do with a shot gun to take the limit to 2 or 3 for waterfowl hunting. A small wooden dowl cut to length works great for a shot gun and should work for your situation. Just cut to length and remove bottom plate and insert into mag and it will rest between the mag spring and bottom plate.

Inox, in the real world of game wardens and judges, there are handguns, rifles and shotguns.

Do NOT, repeat, do NOT try to play word games with these people. When you start getting cute, their sense of humor is between Slim and None, and Slim already left town.

Tube magazine, lever action rifles aren't restricted to this five-round limit, SFAIK. It's a box-magazine thing, mostly, although it includes Garands in some states.

Check with your local gamewarden or call up to the state game department to get clarification on the issue (make sure to write down who you spoke with and date time etc.. just in case). As far as my state is concerned with mag capacity it is limited to waterfowl (shotguns no more than 3 rounds) and deer/elk/mt. goats/mt lions where you can only have an auto with a 6 round capacity (called the local game warden to confirm this on my enfield and he said only restriction is on auto's no limit on bolt/pump guns) also went to my states game fish and parks website and looked up the rules and regs for both waterfowl and big game. just google your states GFP site and look at the regs. to get more guidance call the warden. Better to err on the side of caution like what art said, there is no discussion when you get caught doing something that might be illlegal.

When playing word games, it is important to not get the game turned around on you.

OK, so let's say the game warden wants to play along with you on the carbine vs rifle thing. You want your carbine to be a pistol because it uses pistol cartridges, right? OK.
1- The 45 ACP cartridge in a pistol is not legal for hunting in most states.
2- Most states define a pistol cartridge legal for hunting as being longer than xx inches or having more than xxx ft-lbs.
3- If it is a pistol, you could be cited for having a weapon in violation of the NFA, which prohibits pistols with barrels over a certain length (16" if I remember correctly).
4- If you Google the word "carbine", you will find it refers to a short rifle.

Save yourself headaches and heartache and don't play games.

I don't know about your state. Here in MA, the Environmental Police (game wardens) have wide lattitude in their response to an infraction. If you break hunting laws, they can confiscate your hunting gear. How much you piss them off helps determine how much the confiscate, up to and including your hunting boots and your truck.

I suggest that you do not try to play word games with the wardens. They've got no patience for that kind of silliness.
