In Texas the only birds you can shoot legally are:
1. Those that you've been issued a license to shoot (dove, quail, ducks, etc..) 2. Non-native game birds (you still must have a license) 3. Grackles & crows (sometimes, check the TPWD regs) 4. With a special Permit the brown-headed cowbird. Note that any type of migratory bird (I don't know if WP is a MGB), is regulated federally and in some cases by treaty with Canada and Mexico. You kill those birds, you might be losing some weight down at the Basdrop Federal Correctional Facility or maybe even with Martha Stewart. Houston is home to many different types of woodpeckers. All IIRC have red heads. Maybe you could charge birders to watch the woodpecker, or if that isn't an option there is always the old Texas tradition of the three s's. (Shoot, Shovel, Shut-up).
