Tenn. Firearms Freedom Act

Tennesee's "Firearms Freedom Act" has recently become law-the first in the nation. The law basically says that firearms made in TN, to be sold and used in TN are NOT subject to federal law. ATF is having a fit, sending letters to dealers-telling them the law is worthless and that they will prosecute federal violations. The 10th amendment says otherwise. Waiting on a court case to see how this works out. Makes me proud to live in TN-just not in Memphis!

Thought Montana had this too, maybe theirs is still sitting in legislation.

At any rate, HOOOOOOOOOOO-RAH!!!!!! Hope Nevada is smart enough to follow suit.

On May 12. 2009, the Montana Firearms Freedom Act was signed by Montana Governor Brian Schweitzer and goes into effect Oct. 1, 2009.

The Tennessee Firearms Freedom Act (HB1796/SB1610) was passed on June 3, 2009. Returned without the Governors signature on June 22, 2009. It went into effect on June 29, 2009.

So while Montana was the first to pass such a law, Tennessee was the first to have the law go into effect.

If I recall correctly, Montana had a way of getting standing in the courts to test the law, without getting anyone arrested. Something about applying to the ATF for a federal exemption or something like that. Any word if Tenn is following suit?

And on the flip side, what exactly will the Tenn (and Montana) laws be on the subject of production, sale, and trade? If federal law no longer applies (theoretically), will there no longer be background checks?

Are there any firearms manufacturers of note in Tennessee?

My guess is that FFL's cant sell them because they are already in an agreement with the federal government in order to sell them. But I believe it means that if you build a MG with parts you made it would be perfectly legal as long as your not a FFL

Barrett Firearms is in TN.
I figure someone will get busted with a home-made silencer or MG and then there will be a test case.
