a question

My son will be turning 18 soon and I would like to buy and gift him a pistol.
With him being under aged would this be a legal procedure or will I have to wait
three more years.

In many states, an 18 year old can buy and possess a gun obtained from another individual, but not from a FFL dealer

You need to find and read your states statutes carefully

In addition to what the other posters have stated or asked... Contrary to frequently parroted misinformation, federal law does NOT give family members any special privileges or status as it relates to firearms transfers, gifts or otherwise. IOW under federal law, a transfer to your son is legally considered the same as a transfer to a neighbor, a coworker, a fellow churchgoer, the clerk at your local Golden Arches, or whomever.

(State law varies.)

Going by the name I'm guessing the state is Wisconsin?

Yes I am from Wisconsin and we both live in the same state. A person his age can own and open carry a handgun but can not purchase one from a dealer. It is legal for him to buy from a private party. He has a perfect background and is very responsible I just wanted to get him something he wanted. I will give him cash and let him buy a long gun of his choice and gift him a pistol when he is 21.

Why......if it is legal for him to own a handgun now but just not purchase ammunition he might as well own a handgun now so he can use it if he has to.

See Question 11.a. of the ATF form for purchase from a dealer, as well as its explanation. If you buying the gun with your money as a gift for your son, you are the actual acquirer as far as the feds are concerned. (Wisconsin state law I don't know.)

You say that state law permits him to puchase from a private party. I assume that means he can own the handgun and the question is if an 18 year old may be gifted one under Wisconsin law. What does it say? Check that, if he may legally own a pistol and if you can give it to him, must you go through any kind of Wisconsin DROS or registration process.

If this is legal, be damned sure that you do not give him the gun until he actually turns 18, else you have committed a felony under state law. WI statute 948.60
