Form 5 question

I know a form 5 allows for tax free transfer of an NFA item for cases of inheritence.

My questions are as follows

Is the form required to be filled out and signed off by your local chief of police or sheriff and approved by the ATF before the death of the giver?

If the giver has died before the approval goes through who is legally allowed to store/posess the item? Must it be turned over to the police or ATF or a class three dealer while the paper work goes through?

Anything else I haven't thought of?
