Texas, wait time

Firearms purchase wait time.
I was told by my gunshop that on ATF delays; after 3-business days-no news
is good news and a proceed order is not necessary to release the weapon.
Am told by local sporting goods store (Academy) that they must receive an
order to proceed before they will release the rifle.
Are my 2d Ammendent Rights being violated again?
Any Knowledgeable info would be appreciated.

There is no law that requires an FFL to transfer a firearm after a 3 business-day wait. If an FFL choses to only make a transfer after a "proceed" response, that is a legal option. If an FFL chooses not to sell to you because your pants are hanging too low, that is also legal. The Second Amendment, at this point, does not apply to businesses or private property, only government entities.

Don is also correct. Academy doesn't have to sell to you if they don't want to.
