making small black powder pistols to sell with out a FFL license

hi all, I was wondering what the legalities would be if I were to make small derringer type black powder pistols as replicas to sell. I was thinking to avoid messing with the feds I would make the barrel and just leave a 1/64 inch of metal in the flash hole. Something that could be easily punched through by a buyer, but would prevent the gun from functioning unless modified. And it would have some thing that said "do not alter the flash hole in any way" etc etc.

What do you guys think?

There are no federal regulations on making/selling black powder guns.

After you've made sure that you'll be in compliance with state and local laws and regulations.

Some states treat black powder guns as firearms, others don't, and if you're setting up a business, there will be general legal hoops you need to jump through, as well. You'll also need to have liability insurance.

It's a good idea to consult a lawyer when setting up any business; I'd say it's essential for someone who wants to manufacture anything that goes bang.

Study the tax status.
The IRS ran John Bivens out of the flintlock business by discovering he owed them thousands in exise taxes.

Before selling a single item, you should make certain you have the right kind, and the right amount of, umbrella liability insurance.
