At what point does this run afoul of BATF for ordinary mortals?

Do-it-yourself Kalashnikov from a shovel. The URL is from a site that is not family friendly. Just a hint. Also close to a drive-by, but I'll let it go for a bit. GEM. Last edited by Glenn E. Meyer; November 25, 2012 at 12:32 PM. |

AK receiver flats are easy to find, he just made his from a shovel. If you build with the intent to sell you are required to obtain an 07FFL.

During hearings on the late assault weapons ban, a welder from Camden Ar. Had his assistant, a high school student, build a "grease gun" from parts commonly found and purchased at the local hardware store.
The Congressman enjoyed shooting the piece after the hearing adjourned. |

That said, it's untransferable in its current state, and getting caught with it by an LEO who doesn't know the law (and how many folks would know this?) could be a real issue.

Why would it be untransferrable? While you can't build guns with the sole intention of selling them as a business without the right license, you can still sell a gun that you built for yourself and later decided you didn't want.
I see nothing about that shovel AK (so AWESOME) that would make it unsellable. You're not required to have serial numbers or anything on the gun. BTW those are damn good groups for a shovel AK. Or really any AK for that matter. |

Cause shovels don't come with serial numbers.

Couldn't he just register it and have a serial number assigned to it in the event he wanted to sell it?

If they say (and they could) that he's now in the business of manufacturing, then he's got to get a Type 07 FFL, as well as doing the whole ITAR dance. There's the whole Form 1 process, under which a private individual can get approval to manufacture NFA items for personal use, but this isn't an NFA item.

You don't need serial numbers or any sort of markings on a gun you made if you're not an FFL, even if you decide to sell it. And you don't need to be an FFL to sell a firearm you made for your own personal use.
So he is OK selling this as-is, as long as he doesn't start cranking them out by the crate-load and offloading them on gunbroker. At that point he would be in the business and would need to get an Type 07 FFL and start serializing the guns. |
