Did you let them in? The answer appears to be yes, so it's legal.

Indeed, it seems there was plenty of consent to the search.

You let them in and answered their questions. That makes it all legal. However...

That would only ever happen in NY city. The rest of the state has no registration on long guns and FTF transfers are perfectly legal.

From the LIF.com link provided:

I guess, I'm wondering if this kind of visit is not covered under the circumstances of having a permit issued. Did any of the instructions or other accompanying literature along the way of obtaining a permit state that this kind of visit might be conducted? It would not surprise me to discover a paragraph that included a statement the lines of "Here's your permit that contains the ser no of your Benelli M4. Oh, by the way, NYPD has the authority to, at some random point in time, visit at the residence address on this permit and verify compliance with all requirements of the ordinance that governs its issue. blah, blah, blah." Something along those lines. A compliance inspection. After all, that's all it seems to have been. For all it seems that could happen in an antigun environment such as NYC, this appears to have been a fairly straight forward compliance check. But apparently it is unusual. Is that right? |

And this is why I could never go to NYC on vacation. I CC when I travel, and if I had to use it to defend my life I would go to jail for having it. Lovely...

Leave the references to Nazis, Hitler, Fascists, etc., OUT of this thread, folks. If that's the best that you can do, then don't.
If anyone wonders why their post might have disappeared, see the above paragraphs.

This is why registration is a horrible idea. It give the police too much information about law abiding citizens and it leads to police doing "compliance checks" and questioning citizens absent any probable cuase to believe a crime has been committed..

I used to live on Long Island and I had a "concealed carry permit" while there. It only allowed carry to and from a range or while hunting. Wouldn't even think of carrying otherwise, probably land up in jail. It is very refreshing to live in an area that realizes our right to carry. It is too bad that NY and many other states have felt it necessary to restrict the law abiding citizens and not the true criminals.

Thats funny, here in Kentucky, if a cop asks to see your gun its cause he is about to shoot it, at the range. That would suck..........

Yeah here in VA the proper response would be no but please feel free to come back with a search warrant. I don't have anything to hide, but I'm not going to have a bunch of LEOs walking around my house for no reason either. My rights are my rights and I'll exercise them as I see fit.

I think the OP from LIF did the right thing. Why make a fight of something that isn't a fight. You have a city issued permit; the city is probably legally allowed to ensure compliance with that permit.
I think there's no story in this story. Now, the fact that NYC makes it so hard to exercise your 2nd Amendment rights in the first place, or even requires the permits, well, that's a story. |
