Buffalo Wild Wings and No Guns

I've written corporate expressing my displeasure with their No Gun policy and that if this doesn't change I'll no longer frequent the place. This restaurant is one mile from my home.

Was in there a week ago for a work function and didn't know. A buddy and I went to the head at one point and he noticed me "adjusting". He carries semi-regularly and knew about the policy... "hey man, they've got a sign on the door"... "oh, really?"

So I went out and looked for the "sign" and it took me a minute. I usually look for a big red circle-X with a gun in it and this was just big white letters right in the middle of the door... I totally missed it until I left.

The fact that it's so big is clearly meant as [something more than] simply corporate following the suggestions of the lawyers. Somebody in BWW upper management is obviously very anti-gun and chose this course of action.

I would help them advertise their noble decision to ban guns from the premises. I would write all the local gun clubs, ranges, and sporting goods stores in the area, and attach a picture of their front door in the e-mails. I know I would appreciate someone letting me know of their policy before I wasted a drop of gasoline driving there.

As far as I know they can't make you stop carrying. They can ban you from the restaurant if they find out but if it's concealed it's concealed and I don't believe a company can make it illegal to carry a gun on their premises

This is worth checking out the local/state law. In many states, the business owner (or his representative) can ask you to leave, and if you refuse you can be charged with trespassing, but otherwise there's nothing inherently illegal about carrying in a private business where guns are prohibited.

But, I believe there are a few places where this is not the case, and simply carrying inside a private establishment where it's prohibited is actually illegal.

(Because gang-bangers and felons who ignore the law as a matter of course will suddenly come to Jesus over this stupid sign. Now don't you feel safer?)

There, I fixed it for them.

Depends on the state. In a lot of states, signs like this carry force of law; if you carry there and they find out, they can have you arrested.

Ummm, its not a corperate policy. Every one I have ever visited here in Texas allows CCW.

Bad advice your giving there. Here in Texas if a store has a 30.06 or a 51% sign then you are not allowed to carry and is a felony if caught even with your CCW.

Not necessarilly bad advice, the guy just said it wrong. THAT sign in Texas is not a legal way to bar anyone from carrying a concealled weapon. Only a 30.06 or a 51% sign can do that, this particular sign is a joke. Oh yes they can ask you to leave but no one is getting arrested or being confiscated, only escorted out and then what about the bill?

TMD, it varies by state. In Missouri, that sign would have no force of law, unless a) the carrier were noticed, and b) the carrier then refused to leave if asked to do so.

In Texas, yes; in other states, no. In many states, that sign would be plenty to have you arrested and charged.

I never intended it to be advice since I'm not knowledgeable enough (or a lawyer) obviously. Just discussion.

the truth

the truth about gun free zones. I have printed and taped some of these on doors of such businesses before.

I have never questioned the legality of these signs. I'm happy to spend my hard-earned money elsewhere and I'm not about to sit around waiting for the next looney-toon to get crazy at a gun-free zone.

If you are lucky enough to live near one, go to quaker steak and lube instead. Their wings are MUCH better than BWW.

In AZ, the sign has to have specific features to be enforceable. Tthe law is as follows;

Licenses; Handguns; Posting of Notice
A.
A person with a permit issued pursuant to section 13-3112 may carry a concealed handgun on the premises of a licensee who is an on-sale retailer unless the licensee posts a sign that clearly prohibits the possession of weapons on the licensed premises. The sign shall conform to the following
requirements:
1. Be posted in a conspicuous location accessible to the general public and immediately adjacent to the liquor license posted on the licensed premises.
2.Contain a pictogram that shows a firearm within a red circle and a diagonal red line across the firearm.
3.Contain the words, "no firearms allowed pursuant to A.R.S. section 4
-
229".
B. A person shall not carry a firearm on the licensed premises of an on-sale retailer if the licensee has posted the notice prescribed in subsection A of this section.

Even if they posted an improper sign, I would still not solicit that specific locale. If they do not want my business, I will not give it to them.

Major point -- Laws vary by state. Know the laws of your state. I try not to visit establishments with these signs but occasionally have to do so. I try to honor their wishes since I'm on their property. Occasionally, there will be a business that will post a sign that does not grab my attention (no specific size requirement in my state). I patronized a bank for at least a couple of years until I noticed a "no guns" sign about three inches from the bottom of the glass entry door. I'm sure glad Kentucky just allows the owner/manager to bar access to the premises, rather than turning them into automatic criminals.

My daughter works at one and I visit there every now and again. I don't disarm and she knows it. I'm quite sure her manager knows it too.

We've been having a real issue with these signs popping up everywhere in OK. My local bank put one up and I went to talk to the manager about it. He "assured me" that the intent of the sign wasn't to keep out people with a concealed permit. It was intended to keep out the newly legal in OK, the open carry types. I told him I still didn't want to have to see that sign every time I walked into the bank.

In OK, the sign doesn't have "the force of law." If they figure out you are armed, they can ask you to leave. The problem is that these signs are essentially creating a new space: the no legal open carry space. Despite the fact that we have seen zero problems in OK with open carry.

So yeah, concealed means concealed and I would walk in right past the sign in OK. But it WOULD mean I couldn't open carry in there. I couldn't be arrested but I could be asked to leave almost immediately.
