You're right. That's why I say he had the responsibility to know and not fire in that direction. If he
did know and just thought "Well, it's probably OK..." he should be tried for negligent homicide or 2nd degree murder or some such thing. I'm no lawyer so I don't know the names necessarily but in that case it should be whatever is one step down from intentional premeditated murder.
