The laser is not a flashlight. It is a sighting system. It is not supposed to be lighted up at any time except when you are in the very act of firing the weapon.
If you use the laser as it is intended to be used (as a
sighting device, not as a flashlight), the only time the perp is going to see your laser is at the very moment the shot is fired. And the perp will have other things to think about right then...
