Yes. However, aimed fired (using the sights) is not always possible. Thus the importance of being able to utilize threat focused shooting.

If you use the sights and hit something you shouldn't, you're not any more or less liable than if you used the threat focused shooting. If you don't use the sights and you hit your target, you aren't any more or less liable than if you used the sights.
