Perfectly legal, as long as you don't have uppers for the pistol laying around with a rifle lower just laying around.
You can have multiple uppers for the pistol, as long as you only use them for the pistol.
You can even have a rifle with it - as long as it only has rifle length uppers on it.
Having an 'extra' rifle lower and an 'extra' pistol upper is where you'd be breaking the law.
