Kachalsky would get cert, but on retrospect, it may be a good thing it didn't. Emotions and politics are running high right now about Newtown and various gun control measures. While the Supreme Court justices are supposed to be immune to both, they are human beings and can't help but be effected. So, maybe a "cool down" period will be helpful. I'm a "glass half full" type of guy.
