Trying to get a California CCW by arguing that they must issue one to non-residents or it's discrimination is a weak argument that will get you nowhere.

The state of California is not discriminating against you. If there were a right and California only recognized it for residents then you might have a point. But under current case law there is no right to carry and states are free to determine who may carry.

Until the SCOTUS holds some right to carry nation wide and applies the 2A to the states you will not get anywhere.

And in order to make that happen you need a few rulings in between.

1. You need the 2A incorporated.

2. You need a holding of the right to carry

3. Then if California only allows residents to carry you will have a case.
