Nonetheless, it is the current law. If anyone has the inclination and money to challenge it, the courts are open for business.
Of course, it might be a tough sell in court. Under the the Controlled Substances Act of 1970, the Federal Government claims complete jurisdiction over traffic in controlled substances (21 USC 801). This has been upheld by the United States Supreme Court in
Gonzales v. Raich, 352 F.3d 1222 (2005).
