The safest option would be to assume that if the dude is crazy enough to say such a thing to you while you've got a gun pointed at him, that he's crazy enough to carry it out.

If 's he's laying down, have him stand up, THEN murder him.

Sure, you'll have some legal hassles, more serious in some places than others. But let the lawyer handle it, keep your mouth shut, and you'll likely walk. After all, he's in YOUR house at o'dark thirty.
Why should you have to live in fear of some a88hole coming back days or years later to kill you? Do you REALLY want to be worrying about when this idiot paroles?
And what about his clique/car/gang/homies? They may not sit around waiting for the witness (YOU) to testify against one of theirs.
Normally I'm not for murdering another human being (NOT BG, Goblin, or other such euphemisim), but this is one of those "forced to" situations.
Normally people who make threats are just talking out the side of their neck, but he's demonstrated a willingness to go and do things that 99.9% of people aren't, so I'd have to assume he's one of those .1% crazy enough to murder too.
