Suing your employer sounds dandy after you are fired but:
1. Who is paying your lawyer? Will a lawyer take your case on contingency?
Probably not - the big bucks are in large class action suits.
2. Your company has resources to keep you in court for quite a long time. Who is paying the bills then? You have to eat. Who will hire you in the mean time?
If you make money on another job - your damages are limited to the little time you are out of work. Not much to go on.
